Agreement and Scope
This Terms of Use Agreement (“Agreement”) governs your use of the trueTest website located at www.TrueTest.com or 1TrueTest.com and any related services (collectively, the “Site”). The Site is powered by and operated under the authority of 1 True Health, Inc. (“1TH,” “we,” “us,” or “our”).
trueTest and 1TrueTest.com are services powered by 1 True Health, Inc. All use of the Site, including communications, transactions, and services, defaults to and is governed by the 1 True Health Terms of Use available at https://1truehealth.com/terms-of-use/ (the “1TH Terms”), which are incorporated herein by reference in their entirety.
This Agreement supplements the 1TH Terms by addressing features specific to trueTest, including the purchase and initial management of direct-to-consumer neurological and cognitive tests. In the event of any conflict, ambiguity, or gap, the 1TH Terms shall govern and control, particularly with respect to post-test facilitation, provider review, care navigation, and any clinical or service-related activities.
Nature of the Services
The Site provides a platform for users to learn about, purchase, and manage direct-to-consumer neurological and cognitive tests.
Once a test is completed and submitted, trueTest facilitates transmission of results to 1TH, which arranges for an independent licensed provider in your state of residence to review the results and return a report.
All post-test services, including provider review, are governed exclusively by the 1TH Terms.
Acceptance of Terms
By accessing or using the Site, including making a purchase, you agree to this Agreement and the incorporated 1TH Terms. If you do not agree, you may not use the Site.
Additional terms presented at checkout or within specific services are incorporated by reference. In all cases, the 1TH Terms govern to the maximum extent permitted.
Eligibility and Territory
You may only use the Site if you are at least 18 years of age and located in the United States (including Alaska and Hawaii), subject to state-specific availability restrictions.
Required Pre-Purchase Acknowledgments and Authorizations
Emergency and Symptom Warning
This service is not intended for emergencies or acute neurological changes. If you experience severe symptoms (for example, sudden confusion, memory loss, personality changes, or difficulty speaking), seek immediate medical attention or call emergency services.
No Medical Services; No Provider-Patient Relationship
1TH facilitates administrative aspects of testing, including purchase and coordination. Neither trueTest nor 1TH:
- Practices medicine
- Interprets results
- Provides medical advice
- Establishes a provider-patient relationship
Any reviewing provider is solely responsible for clinical interpretation and recommendations. You agree to follow up with a licensed provider for any concerns.
Medical Disclaimer
All information and services provided through the Site are for informational and screening purposes only and are not intended to diagnose, treat, cure, or prevent any disease. The Site does not replace professional medical advice, diagnosis, or treatment.
Limitations and Risks
Test results:
- May be affected by external factors (fatigue, medications, mood, environment, and similar factors)
- May include false positives or false negatives
- Are screening tools only and not definitive conclusions
These tests do not replace a full clinical or neuropsychological evaluation.
Regulatory and Test-Specific Terms
Use of tests must comply with applicable regulatory requirements, including FDA-cleared labeling where applicable. Certain tests may require licensed provider involvement.
Use of third-party testing platforms (for example, CNS Vital Signs) may require acceptance of their terms and policies. Availability may vary by state.
Privacy and Data Sharing Authorization
By purchasing a test, you consent to the collection, use, and sharing of your information (including health information) with testing facilitators, testing companies, and licensed providers. All data use is governed by applicable law, the Privacy Policy, and the Notice of Privacy Practices.
General Disclaimer; No Warranty
All services are provided “as is” and “as available.” To the fullest extent permitted by law, 1TH disclaims all warranties, including accuracy, reliability, and fitness for a particular purpose.
Affirmative Acknowledgment
By completing a purchase, you confirm that you have read and understood these acknowledgments, agree to this Agreement and the 1TH Terms, and authorize 1TH to facilitate your test purchase and workflow.
Purchases, Technical Requirements, and Refund Policy
Technical Requirements
Certain tests require a desktop or laptop computer and cannot be completed on mobile devices. You are responsible for ensuring compatibility before purchase.
Order Finality
Once a test has been accessed or started, the purchase is considered used and is generally non-refundable.
Retesting Policy
Users may retake a test up to three (3) times at no additional cost if technical or usability issues occur, as determined by 1TH or its partners.
Refund Eligibility
Refunds are only available if:
- The test has not been started or accessed, OR
- The purchase was made without understanding the desktop/laptop requirement and the test has not been started
Non-Refundable Situations
Refunds will not be issued if:
- The test has been started or completed
- Results have been generated or submitted
- Issues are unrelated to system compatibility
Refund Processing
Approved refunds will be issued to the original payment method within a reasonable timeframe.
Acceptable Use
You agree to use the Site only for lawful purposes and in compliance with all applicable laws. Prohibited uses include:
- Fraud or misrepresentation
- Violations of privacy or intellectual property
- System interference (including malware, hacking, or disruption)
- Misuse of medical or personal data
HIPAA and Data Compliance
You agree not to use the Site in a manner that violates applicable privacy laws, including HIPAA. Certain services may involve HIPAA-regulated entities, as described in the Privacy Policy and 1TH Terms.
Electronic Communications and SMS
You consent to receive communications electronically, including email and SMS (where applicable). Messaging terms, frequency, and opt-out procedures are governed by the 1TH Terms.
Disclaimers and Limitation of Liability
To the fullest extent permitted by law:
- Services are provided “as is”
- 1TH is not liable for indirect, incidental, or consequential damages
- 1TH does not guarantee outcomes or suitability of tests
Indemnification
You agree to indemnify and hold harmless 1TH from claims arising from your use of the Site, violation of this Agreement, or misuse of test results.
Intellectual Property
All Site content is owned by 1TH or its licensors and may not be used without permission.
Termination
1TH may suspend or terminate access at any time for violation of this Agreement or applicable law.
Governing Law and Dispute Resolution
This Agreement is governed by the laws of the State of Texas. All disputes shall be resolved exclusively in courts located in Austin, Texas. Any claim must be brought within one (1) year.
Changes to Terms
1TH may update this Agreement at any time. Continued use of the Site constitutes acceptance of updated terms.
General Provisions
If any provision is unenforceable, the remainder shall remain in effect. Failure to enforce any provision does not waive future enforcement rights.
